Litigation and Dispute Resolution

When an individual or company faces litigation, whether as a plaintiff or as a defendant, they must consider a number of factors, including: costs, benefits, and other risks that are likely to have a significant impact. For business clients this can be a significant impact on the company’s bottom line. Monetary recovery or exposure, the level of litigation expenses, and the effect off potential court decisions or orders can have a significant impact. We regularly represent clients in proceedings in Washington State and federal courts, as well as in proceedings before other administrative and regulatory agencies.
We have handled cases ranging from the relatively simple to the complex, involving such issues as: domestic relations, employment contracts, supply contracts, corporate governance, real estate, trespass and adverse possession, and personal injury.
We offer various legal assessments, including risk assessments, to provide our clients with an evaluation of the risks and costs associated with the litigation under consideration. When appropriate, we assist clients in resolving disputes through arbitration, mediation, and other cost-saving alternative dispute resolution methods.

Possinger Law Group’s approach to dispute resolution is not restricted to just litigating cases.  Even though being ready and able to take a case to trial is an essential part of the dispute resolution process, it is only one of many tools available for our clients to achieve the results they are seeking.  Possinger Law Group’s services geared to appropriately meet our client’s goals and objectives.

Negotiation is the oldest form of dispute resolution. Possinger Law Group assists its clients with every stage of negotiating disputes, from assisting in the preparation phases, representation during the negotiation process, as well as preparation of the relevant settlement agreements and follow-through.

In those cases where Negotiation is not possible or advisable; Mediation of disputes is often an effective means of resolving the dispute through a process of facilitated negotiation with the aid of a neutral mediator. Possinger Law Group has represented clients through he mediation process to reach results that have been acceptable to is clients.

Arbitration is an agreed upon form of dispute resolution. It is very common in business and commercial disputes. Though private and out of the civil court system, professional counsel and representation is often required to successfully achieve meaningful and enforceable awards. Possinger Law Group has successfully represented clients in both domestic as well as international arbitration proceedings.

Sometimes the only way to resolve a legal dispute is the use of the court system; when other means of reaching resolution are not available, having lawyers ready to take a case to hearing or trail is an essential component to Possinger Law Group’s arsenal.  For every matter that comes to us, thinking about how we will take the case successfully to trial is part of every case.
